The non-compete clause directly protects PHC Cleaners, confidential information, intellectual information, proprietary information, clients and employees of PHC Cleaners LLC or PHC Property Services LLC or any sister company of either organizations.
By electronically signing this non-compete clause you adhere to the contractial laws that you understand the verbage of this clause and adhere to the premises of the contract.
By electronically signing this clause you fully understand and agree to the following :
- The utilization of any contact lists, current client, past client and/or potential client of PHC Cleaners LLC is prohibited by any current or past employee of PHC Cleaners for the benefit of
one’s self or directly benefiting a competitor of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC.
- The utilization of any employees information of any current staff of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC to benefit one’s self or direct competitors of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC.
- The utilization of any customer contact information of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC to benefit one’s self or direct competitor of of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC.
- The utilization of any equipment, tools or resources owned by PHC Cleaners LLC, PHC Property Services or any subsidary of PHC to benefit one's self or direct competitor of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC.
- The utilization of any intellectual property that may consist but is not limited to any processes, resources, systems and procedures to benefit one's self or direct competitors of PHC Cleaners LLC, PHC Property Services or any subsidary of PHC.
- The Employee specifically agrees that for a period of 6 months after the Employee is no longer employed by PHC Cleaners LLC, PHC Property Services or any subsidary of PHC,
the Employee will not engage,directly or indirectly, either as proprietor, stockholder, partner, officer, employee or otherwise, in the same or similar activities as were performed for the Company
in any business within any state in PHC Cleaners LLC, PHC Property Services or any subsidary of PHC which distributes or sells products or provides services similar to
those distributed, sold, or provided by the Company at any time during the 6 months preceding the Employee's termination of employment.
- Employee agrees that for 6 months after employee is no longer employed by PHC Cleaners LLC, PHC Property Services or any subsidary of PHC the employee will not directly or indirectly solicit, agree to
perform or perform services of any type that PHC Cleaners LLC, PHC Property Services or any subsidary of PHC can render ("Services") for any person or entity who paid or engaged PHC Cleaners LLC, PHC Property Services or any subsidary of PHC for services,
or who received the benefit of the company's Services, or with whom Employee had any substantial dealing while employed by PHC Cleaners LLC, PHC Property Services or any subsidary of PHC.
However, this restriction with respect to Services applies only to those services rendered by employee or an office or unit of the company in which Employee worked or over which Employee had supervisory authority.
This restriction also applies to assisting any employer or other third party.
